Summary:

ORDINANCE appropriating $655,192.00 out of Parks & Recreation Dedication Fund; awarding construction contract to JERDON ENTERPRISE L.P. for Cullen Park - Playgrounds; setting a deadline for the proposer's execution of the contract and delivery of all bonds, insurance and other required contract documents to the City; holding the proposer in default if it fails to meet the deadlines; providing funding for engineering and materials testing services, and contingencies relating to construction of facilities financed by the Parks & Recreation Dedication Fund - DISTRICT A - STARDIG

Background:

SPECIFIC EXPLANATION: The General Services Department (GSD) recommends that City Council award a construction contract to Jerdon Enterprise, L.P. on the proposal amount of $611,611.11 to provide construction services for Cullen Park - Playgrounds for the Houston Parks and Recreation Department.

PROJECT LOCATION: 19008 Saums/18203 Groeschke (447S)

PROJECT DESCRIPTION: Cullen Park currently has six play areas. Two of the play areas consist of posts and decks and offer no play value. Play components were removed over time due to safety concerns and their replacement parts are no longer available in the trade. This project will demolish three of the remaining playgrounds, which are over 25 years old and will install two new playgrounds with more play components. The scope of work consists of demolition of concrete borders, remaining playground equipment and pea gravel surfacing, asphalt trail section, old concrete pads and picnic tables; construction of new concrete play borders, installation of new play equipment and swing sets, poured-in-place play surface, new picnic tables and barbeque pits, and decomposed granite surfacing at an existing picnic area.

The contract duration for this project is 150 calendar days from the issuance of the Notice to Proceed for construction. Clark Condon Associates is the design consultant for the project.

PROPOSALS: On January 15 and January 22, 2016, GSD advertised a Request for Competitive Sealed Proposals (CSP) for construction services for Cullen Park - Playgrounds. The CSP contained selection criteria that ranked respondents on experience, references, schedule and contractor responsibility. The Statements of Qualifications were due on February 4, 2016, and eight firms responded. GSD evaluated the respondents, and four of the eight firms received sufficient points and were requested to submit proposals. All four selected firms submitted proposals on March 17, 2016. Jerdon Enterprise, L.P. submitted the lowest proposal and offers the best value for the City based on the advertised criteria.

The four proposers are ranked as follows:

AWARD: It is recommended that City Council award the construction contract to Jerdon Enterprise, L.P., and appropriate funds for the project, including an additional appropriation of $13,000.34 for engineering and materials testing services under an existing contract with HVJ Associates, Inc.
  
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s “Pay or Play” Ordinance regarding health benefits for employees of City contractors. In this case, the contractor provides benefits for some employees but will pay into the Contractor Responsibility Fund for others, in compliance with City policy.

HIRE HOUSTON FIRST: The proposed contract requires compliance with the City’s ‘Hire Houston First’ (HHF) Ordinance that promotes economic opportunity for Houston businesses and supports job creation. In this case, Jerdon Enterprise, L.P. is a designated HHF company, but they were the successful awardee without application of the HHF preference.
