RECOMMENDATION: (Summary) Approve an ordinance appropriating additional funds to the Construction Management and Inspection Services Contract with Weston Solutions, Inc.
PROJECT NOTICE/JUSTIFICATION: These projects are associated with the City’s program to provide sanitary sewer to the Unserved area within the City limit.
DESCRIPTION/SCOPE: This Contract provides for Construction Management and Inspection Services for Construction Branch of the Department of Public Works and Engineering in connection with sanitary sewer service to Unserved Areas Package 1: Shared Facilities (Regional) Sanitary Sewer Improvements – Magnolia Point Lift Station, Force Main & Trunk Main; Strange’s Camp Lift Station & Force Main projects.
LOCATION: The projects are located throughout the City of Houston

SCOPE OF THIS SUPPLEMENT AND FEE: The City Council approved the original Construction Management and Inspection Services Contract on June 1, 2011 under Ordinance Number 2011-0411 with Weston Solutions, Inc. and appropriated $12,000.00 for limited pre-construction review. This Contract was referenced in Ordinance No. 2013-0422 to perform Construction Management and Inspection services for the Amy Ridge and Hiram Clarke Lift Station Diversion. The construction contractor exceeded the time to complete the project by more than 50 percent of the original contract time. Under this Contract, the consultant required additional funds to continue performing Construction Management and Inspection services. The increased funds are due to the construction contractor, BRH-Garver Construction, L.P. failure to complete the project within the contract time. The requested appropriation will complete the Construction Management and Inspection services for the proposed Amy Ridge and Hiram Clarke Lift Station Diversion. The total appropriation is $165,000.00 to be appropriated for contract services.
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s “Pay or Play” ordinance regarding health benefits for employees of City contractors. In this case, the contractor provides health benefits to eligible employees in compliance with City policy.
M/WBE PARTICIPATION: The M/WBE goal established for this contract is 24%. The current total authorization for this contract is $1,595,480.80. The consultant has been paid $1,151,258.16 (72.16%) to date. Of this amount, $330,627.93 (28.72%) has been paid to M/WBE sub-consultants to date.
