Summary:

RESOLUTION authorizing the Police Chief of the City of Houston, Texas, to terminate without cause the current Police-Authorized Tow Service Agreement, Contract No. C75884, with USA AUTO COLLISION CENTER

Background:

RECOMMENDATION: {Summary} Adopt a resolution authorizing the Police Chief of the City of Houston, Texas to terminate without cause the current Police-Authorized Tow Service Agreement (PATSA), contract No. C75884, with USA AUTO COLLISION CENTER. 

 
SPECIFIC EXPLANATION
Section 8-126 of the Code of Ordinances authorizes the City of Houston's Chief of Police to execute agreements with tow operators for the tow operators to perform police-authorized tows. I n 2014, Richard Gonzalez signed Contract No. C75884 as the Operator of the wrecker service known as USA Auto Collision Center, thereby indicating his desire to provide auto wrecker services to the City of Houston (''the City'') and agreeing to the terms of the Police-Authorized Tow Service Agreement ("PATSA"). 
 
The PATSA with USA Auto Collision Center commenced on March 10, 2014, for a period of five (5) years, unless sooner terminated or suspended the City's PATSAs provide, in Article Ill, Section 3.03: 'With the prior authorization of the City Council of the City, the Police Chief may terminate this Agreement, without cause, upon thirty (30) days written notice to the Operator'' (emphasis added); and 
 
The Acting Police Chief of the Houston Police Department recommends the City Council authorize her to terminate the PATSA with USA Auto Collision Center, under Section 3.03 of the agreement.
