RECOMMENDATION: (Summary) Adopt a Resolution authorizing the Police Chief of the City of Houston, Texas to terminate without cause the current Police Privates Storage Lot Agreement (PPSLA, contract No. C75129, with the vehicle storage facility known as "STAN'S WRECKER, INC.", situated at 3551 Almeda Genoa, Houston,Texas.
SPECIFIC EXPLANATION:
Section 8-143 of the Code of Ordinances authorizes the Mayor of the City of Houston (''the City''), upon recommendation of the City's Chief of Police, to execute agreements with operators of vehicle storage facilities situated in the City to act as "police private storage lots." On November 26, 2012, Lorenzo Gonzalez signed Contract No. C75129 as President and Operator of Stan's Wrecker, Inc., thereby indicating his desire to operate the vehicle storage facility known as Stan's Wrecker, Inc., as a police private storage lot and agreeing to the terms of the Police Private Storage Lot Agreement ("PPSLA"). The City's PPSLAs provide, in Article Ill, Section 3.03: 'With the prior authorization of the City Council of the City, the Police Chief may terminate this Agreement, without cause, upon thirty (30) days written notice to the Operator'' (emphasis added).
The Acting Police Chief recommends the City Council authorize her to terminate the PPSLA with Stan's Wrecker, Inc., under Section 3.03 of the agreement.
