Summary:

ORDINANCE authorizing the Police Chief of the City of Houston, Texas, to terminate without cause the current SafeClear Freeway Towing and Emergency Road Service Agreement, Contract No. C76536, with USAACC, INC, dba USA AUTO COLLISION CENTER

Background:

RECOMMENDATION: (Summary) Adopt an Ordinance authorizing the Police Chief of the City of Houston, Texas to terminate without cause the current Safeclear Freeway Towing and Emergency Road Service agreement, contract No. C76536, with USAACC, Inc., OBA USA Auto Collision Center. 

 
Richard Gonzalez signed SafeClear Contract No. C76536 as President and Operator of USAACC, Inc., dba USA Auto Collision Center, thereby agreeing to the terms of the SafeClear Agreement. The SafeClear Agreements provide, in Article IV, Section 4.03: ''With the prior authorization of the City Council of the City, the Police Chief may terminate this Agreement, without cause, upon 30 days written notice to the Operator." 
 
The Acting Police Chief of the Houston Police Department recommends the City Council authorize her to terminate the SafeClear Agreement with USAACC, Inc., dba USA Auto Collision Center, under Section 4.03 of the agreement.
